HOW ARE DRUGS CLASSIFIED?

The Texas Health & Safety Code (Texas Controlled Substances Act – Chapter 481) defines the different drug penalty groups to which drugs, like controlled substances and marijuana, are assigned. The state of Texas recognizes eight penalty groups (PG):

DRUG CRIMES AND PENALTIES

Different drug crimes will carry with them different penalties depending on the type of drug and the amount of drugs. There are also significant enhancements that might be applied based on previous convictions and the penalty group of the drug. 

Penalty Group 1

Drugs in this penalty group are mostly narcotics and are heavily regulated. Drugs in this class include opioids (e.g. codeine, hydrocodone, oxycodone), opium derivatives (heroin), cocaine, ketamine, hallucinogens, and others. ​

  • Less than 28 grams 
    • Manufacture or delivery (State-jail felony)​​

  • 1 gram - 4 grams

Drugs in this penalty group includes LSD, which is not determined by grams. Rather, drugs in this penalty group is determined by units. ​

  • Less than 20 units​

  • 20 units to 80 units 
    • Manufacture or delivery (Second degree felony)​
    • Possession (Third degree felony)
  • 80 units to 4000 units

Drugs in this penalty group includes hallucinogenic substances including PCP, Ecstasy, and the like.  

  • Less than 28 grams

Drugs in this penalty group include compounds that try to mimic that of marijuana cannabinoids such as K2. 

  • Less than 1 gram

  • 1 gram - 4 grams

Drugs in this penalty group include sedatives such as Valium, anabolic steroids, Ritalin, and other anti-depressant and stimulant prescription drugs. 

  • Less than 28 grams​

    • Possession (Class A misdemeanor)
  • 28 grams to 200 grams 
    • Manufacture or delivery (Second degree felony)​
    • Possession (Third degree felony)
  • 200 grams to 400 grams
